Website Owner, Offer, and Binding Terms

This website is owned by Isabelle Gervais.Laberge. These Terms of Use set forth the terms and conditions under which you may use our website and the services we offer. This website offers visitors the SALE OF JEWELRY, REPAIR SERVICES, AND BASIC JEWELRY-MAKING COURSES. By accessing or using the website of our service, you confirm that you have read, understood, and agreed to be bound by these terms.

To use our website and/or receive our services, you must be at least 18 years old or the legal age of majority in your jurisdiction and have the legal authority, right, and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

 

Key Commercial Terms Offered to Customers

When you purchase an item, you agree that you are responsible for reading the full item listing before committing to buy it. You enter into a legally binding contract to purchase an item when you commit to buy and complete the checkout process.

The prices we charge for our services/products are listed on the website. We reserve the right to change our prices for displayed products at any time and to correct pricing errors that may occur unintentionally. Additional information about pricing and sales tax is available on the payment page.

Fees for services and any other charges you may incur in connection with your use of the service, such as taxes and transaction fees, will be billed monthly to your payment method.

 

SHIPPING RATES

We offer free shipping throughout Quebec for all orders over $200 placed through our online store.

Order Processing Time
This is the time required to create or prepare the product.

  • For ready-to-ship jewelry: approximately 2 to 3 days of preparation.

  • For out-of-stock jewelry: approximately 3 to 6 business days for crafting and preparation. We will be in touch.

During checkout, a multi-selection tab allows you to choose your preferred shipping method. For more details, please refer to the Terms of Use. A paragraph is dedicated to shipping fees.

 

Rates for Quebec and Ontario
Canada Post (Regular Shipping)
2-7 business days — $5

Canada Post (Expedited Shipping)
2-3 business days — $15

 

Rates for Other Canadian Provinces
Alberta, British Columbia, Manitoba, New Brunswick, Newfoundland and Labrador, Northwest Territories, Nova Scotia, Nunavut, Prince Edward Island, Saskatchewan, Yukon Territory

Information on Special Order Timelines
For all custom-made jewelry, please allow 7 to 20 days for production and delivery (depending on the project).
Delivery times may vary by country.

In-Store Pickup Information
Items can be picked up from the studio-boutique by appointment only, within 3 to 5 business days from the order date. I will provide details via email.

Shipping delays are out of my control. However, if you have concerns, don’t hesitate to contact me. I’ll do everything possible to help until you receive your package.

 

RETURN, REFUND & WARRANTY POLICY
If you are not completely satisfied with your purchase, I accept returns of all items in new condition and original packaging by mail or in person at the CRÉATIONS GLI studio-boutique in Canada within 5 days of your order's arrival. Returns outside this timeframe may be accepted at my discretion.
Refund processing may take 7-20 business days for online or studio purchases. If you received the item as a gift, you may exchange it for a non-refundable item.

International shipments are final sale and cannot be returned.

Refunds will be issued to the original payment method. If not possible, an exchange or store credit will be provided.

Returned merchandise must be new and unused and include all packaging components. Items that are damaged, used, engraved, modified, or resized may be refused and returned to the customer.

If merchandise is damaged during return shipping due to poor packaging, it may not be accepted.

 

Sale items are not eligible for return or exchange in-store or online.
Due to their nature, unless they arrive damaged or defective, I cannot accept returns for:

  • Custom orders

  • Personalized orders

  • Engraved jewelry

  • Sale items

Pack all items in a cardboard box, which can be obtained at the post office.
Returned items by mail must include a copy of the original invoice. Items may be shipped using your preferred carrier to the address on the invoice.Unidentified returns may be sent back to the sender.

 

Return Policy for Jewelry Classes
Jewelry-making classes, regardless of the package purchased, are non-refundable and non-exchangeable for any item or service offered online or at the CRÉATIONS GLI studio.

 

Right to Modify the Offer
We may, without notice, change services; stop providing services or service features; or impose limits on services. We may terminate or suspend access to services permanently or temporarily without notice or liability for any reason or no reason at all.

 

Warranties and Liability for Services and Items
When we receive a valid warranty claim for a product purchased from us, we will repair the defect or replace the item. If we are unable to do so within a reasonable timeframe, the customer is entitled to a full refund upon prompt return of the item. We will pay shipping costs for repaired or replaced items to the customer, and the customer is responsible for return shipping.

 

Intellectual Property, Copyright, and Logos
The service and all materials therein, including but not limited to software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, video, music, and intellectual property rights, are the exclusive property of Isabelle Gervais.Laberge. Unless explicitly stated, nothing in these terms shall be deemed to grant a license under these intellectual property rights. You agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display or perform, publish, adapt, or create derivative works thereof.

 

Right to Suspend or Cancel User Accounts
We may terminate or suspend your access to the service, permanently or temporarily, without notice or liability for any reason, including if we determine you have violated any of these Terms or applicable laws. You may stop using and request to cancel your account/services at any time. However, for auto-renewed subscriptions, cancellation will take effect only at the end of the paid period.

 

Limitation of Liability
To the fullest extent permitted by applicable law, [site owner] shall not be liable for indirect, punitive, incidental, special, consequential, or exemplary damages, including but not limited to lost profits, goodwill, use, data, or other intangible losses resulting from or relating to the use of or inability to use the service.

To the maximum extent permitted by law, Isabelle Gervais-Laberge assumes no liability for any errors or inaccuracies in content, personal injury, or property damage resulting from access to or use of the service or unauthorized access to our secure servers and any personal information stored therein.

 

Right to Change and Modify Terms
We reserve the right to modify these terms at our sole discretion at any time. You should review these pages periodically. If we make material changes, we will notify you accordingly. Continued use of the website or our service after changes constitutes your acceptance of the new terms. If you do not agree with the updated terms, do not use or access (or continue to access) the website or service.

 

Promotional Emails and Content
You agree to receive promotional messages and materials from us from time to time by mail, email, or any contact method you provide (including phone calls or texts). If you do not wish to receive such materials, please notify us at any time.

 

Governing Law and Dispute Resolution
These terms, rights, and remedies, and any related claims or disputes, shall be governed by and construed exclusively in accordance with the internal substantive laws of Canada and Quebec, without regard to conflict of laws principles. All disputes must be brought exclusively before a competent court in Saint-Jérôme. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
